1. Acceptance of Terms
By using our website or placing an order, you acknowledge that you have read, understood, and agree to these Terms of Service, as well as our Refund Policy, Shipping Policy, and Privacy Policy.
If you do not agree to these terms, please do not use our website or place an order.
2. Custom Products
The Humble Chisel specializes in custom-made and personalized products. Because each item is manufactured specifically for the customer, all product specifications, customization details, artwork, dimensions, and design requests must be reviewed carefully before submitting an order.
Customers are responsible for ensuring all submitted information is accurate.
3. Design Approval Responsibility
When proofs, mockups, artwork, renderings, or design approvals are provided, it is the customer's responsibility to review all details carefully before approving production.
This includes but is not limited to:
- Spelling
- Grammar
- Names
- Dates
- Dimensions
- Artwork placement
- Layout
- Colors
- Logos
- Custom text
Once a design has been approved by the customer, any errors contained within the approved design become the responsibility of the customer.
The Humble Chisel is not responsible for errors that were present in a customer-approved proof.
4. Pricing & Payments
All prices are listed in U.S. Dollars unless otherwise stated.
We reserve the right to modify pricing, discontinue products, correct pricing errors, or refuse orders at our sole discretion.
Orders are not considered confirmed until payment has been successfully processed.
5. Production Times
Production times are estimates only and may vary based on order volume, customization requirements, material availability, and seasonal demand.
Estimated production times do not constitute guaranteed delivery dates.
6. Shipping & Delivery
Once an order has been shipped and accepted by the carrier, delivery timelines are outside of our control.
The Humble Chisel is not responsible for delays caused by:
- Weather events
- Natural disasters
- Carrier delays
- Transportation disruptions
- Labor shortages or strikes
- Customs processing
- Peak shipping periods
- Other events beyond our control
Shipping delays do not qualify for refunds.
7. Shipping Damage
Customers are responsible for reporting shipping damage promptly and cooperating with any carrier claim requirements.
The Humble Chisel will provide reasonable assistance and documentation to help facilitate claims when applicable.
If a shipping claim is approved, we may provide a replacement product when appropriate.
8. Refunds & Returns
Because our products are custom-made and personalized, all sales are generally final.
Refunds, replacements, or corrections will only be provided when an error is determined to have been made by The Humble Chisel.
If an error was present in a proof or design approved by the customer, the responsibility remains with the customer and does not qualify for a refund or replacement.

9. Intellectual Property
All website content, designs, graphics, logos, photographs, text, product descriptions, and other materials are the property of The Humble Chisel and may not be copied, reproduced, distributed, or used without prior written permission.
Customers represent that they have the legal right to use any logos, artwork, trademarks, images, or other content submitted for custom projects.
The customer agrees to indemnify and hold harmless The Humble Chisel from any claims arising from the use of submitted artwork or intellectual property.
10. Limitation of Liability
To the fullest extent permitted by law, The Humble Chisel shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of our website, products, services, or delays in performance.
Our maximum liability for any claim shall not exceed the amount paid by the customer for the specific product giving rise to the claim.
11. Product Variations
Because products are handcrafted, custom manufactured, and may utilize natural materials, slight variations may occur.
Minor differences in color, grain, texture, finish, engraving depth, dimensions, and appearance are normal and do not constitute defects.
12. Order Refusal & Cancellation
We reserve the right to refuse, cancel, or limit any order at our discretion, including orders containing inappropriate, offensive, unlawful, or infringing content.
If an order is canceled before production begins, a refund may be issued at our discretion.
13. Website Accuracy
We strive to provide accurate product descriptions, images, pricing, and information. However, errors may occasionally occur.
We reserve the right to correct any errors, inaccuracies, or omissions at any time without prior notice.
14. Governing Law
These Terms of Service shall be governed by and interpreted under the laws of the State of New York, without regard to conflict of law principles.
Any disputes arising from these Terms shall be resolved in the courts located within New York.
